Terms of sale and refunds
Who sells it
Kai's Games is made by ResultsExpert Consulting, Bulawayo, Zimbabwe. Orders are processed by Dodo Payments, our reseller and merchant of record. Dodo Payments takes the payment, issues your receipt, handles sales tax or VAT, and processes refunds. Their buyer terms also apply to the payment.
What you buy
A one-time payment buys a licence to one of three packs. The price in your currency is shown at checkout. There is no subscription and nothing else to buy inside the games.
- Starter (US$6.99): the free games plus 5 classic games you choose, plus Living Canvas, on 1 device.
- Family (US$14.99): all the games, plus Numbers Path and Living Canvas, on up to 2 devices.
- Classroom (US$120): all the games, plus Numbers Path and Living Canvas, on up to 20 devices, for one preschool, creche or class.
Starter and Family licences
- With Starter, a grown-up chooses which classic games to unlock when first entering the key. The choice is kept with the licence key, applies on every device, and cannot be changed afterwards. To get every game, upgrade.
- You may use the games on the number of devices your pack covers, used by your household and close family, for any number of children.
- These licences are for personal, non-commercial use at home.
Classroom licence
- One preschool, creche, nursery or class may use the games on the number of devices the pack covers, with the children in its care.
- A group with more than one site needs a Classroom licence for each site.
- Staff may not install the licence on parents' or children's own devices.
All licences
- You may not copy, resell, share the licence key publicly, or reproduce the games, characters, artwork or sounds.
- To move a licence to a new device, remove it from an old one in the Grown-ups menu. If an old device is lost, write to us and we will help.
Upgrades
If you have Starter or Family, you can upgrade from the Grown-ups menu in the app and pay the difference in price. The upgrade key works together with the key you already have. On a device that already has the earlier pack, enter the upgrade key. On your other device, enter the upgrade key and then the earlier key, which is only checked there, not used up. A refund of the earlier pack also ends any upgrade bought on top of it, and we refund that upgrade too.
Launch gifts
During the launch, the new apps come with the packs as listed above at no extra cost: Starter includes Living Canvas, and Family and Classroom include Numbers Path and Living Canvas. A pack bought during the launch keeps them for as long as the licence lasts, even if they are later sold separately or the packs change.
What you can try free
Three games can be played free without buying. Without a pack that includes them, children can also try the first stage of Numbers Path and wake one Living Canvas drawing a day. What is free may change from time to time.
Refunds
If you are not happy, write to hello@kaisgames.com within 14 days of buying, with the email address you used, and you will get a full refund. After a refund the licence key stops working. This does not affect any rights you have under the consumer law where you live.
Updates and availability
Every pack includes fixes and improvements to the games it contains. Family and Classroom also include new games we add. We work to keep the games available and working on current browsers. Because they run in your browser and use your device's own voice, how they look and sound can vary between devices.
Gift cards
You can buy a pack as a gift and make a gift card at kaisgames.com/gift. The card holds the licence key: whoever has it can unlock the games, so keep it safe and send it only to the child's family. Refunds go to the person who paid, and a refunded key stops working, including on a gift card.
Partners
Some people who recommend Kai's Games are partners who earn a commission when you buy through their link. You pay the same price either way, and nothing else about your purchase changes. The partner terms are at kaisgames.com/partners.
Sound credits
The animal sounds are real recordings shared under open licences (public domain, CC0 and, for the giraffe, CC BY-SA 4.0 by Anton Baotic, Florian Sicks and Angela S. Stoeger). The full list of recordists and sources is at kaisgames.com/play/sounds/CREDITS.txt.
For grown-ups
The games are designed for children aged about 2 to 6, played with a grown-up nearby. Please follow your own guidance on screen time for young children.
Liability
We provide the games as they are. To the extent the law allows, we are not liable for indirect losses, and our total liability is limited to the amount you paid. Nothing here limits liability that cannot be limited by law.
Law
These terms are governed by the laws of Zimbabwe, without taking away any protection given to you by the consumer laws of the country where you live.
